UCare Exclusive For Eee PC
Terms and Conditions
A) UCare Extended Warranty for ASUS Eee PC
- This UCare Extended Warranty for Asus Eee PC (hereinafter referred as “UCare”) is endorsed by ZipOne Sdn.
Bhd. underwritten by Multi-Purpose Insurans Bhd.
- This UCare package shall come free-of-charge with the purchase of Asus Eee PC. You shall receive the following items:
- UCare Application Form
- UCare Membership Card
- UCare Booklet (with UCare information and UCare terms and conditions)
B) Product
This UCare only applies to “Asus Eee PC” (hereinafter referred as “Product”) that is:
- purchased new from authorised dealer in Malaysia,
- manufactured for domestic use in Malaysia only
- included at the time of purchase, the manufacturer’s complete and original warranty valid in Malaysia as well as the UCare Extended Warranty, and
- below the retail price of RM2,000.00
C) Definitions
- “Purchase Price” of the Product is the actual value of the Product itself at the time of purchase as stated on the Confirmation Letter and excludes any other component, software or accessory added during or after purchase.
- “Mechanical or Electrical Breakdown” (hereinafter referred as “Breakdown”) means the unserviceability of a component for a reason other than wear and tear, normal deterioration or negligence causing a sudden stoppage of its function.
- “Coverage Period” means the period during the second year from the date of purchase of the Product which ZipOne Sdn. Bhd. shall provide warranty services.
- “Part(s) & Component(s)” means the part(s) and component(s) which are incorporated in the Product by the Product manufacturer.
D) Scope of Coverage
- UCare Extended Warranty covers the repair and replacement of Part(s) and Component(s) in the event during the Coverage Period the Product as registered fails to operate as a result of Mechanical or Electrical breakdown only and only to the extent provided by the manufacturer of the Product under the manufacturer’s warranty.
- The Mechanical or Electrical breakdown or damage must not be the result of negligence, carelessness or intentional.
- ZipOne shall:
- in the case of Breakdown that can be repaired: repair or replace the damaged part(s) or component(s); or
- in the case of Breakdown beyond economic repair: issue a replacement with the same model type, or at ZipOne Sdn. Bhd.’s absolute discretion, replace with an alternative model type of equivalent specifications if the model type is obsolete or no longer available in Malaysia.
E) Activation and Membership Validity
- Please note that you MUST successfully complete the Activation process for your UCareMembership within 30 days of the purchase of the Product. Activation process is only complete upon receiving a Confirmation Letter or E-mail from UCare Service Centre. Your plan will be effective within 3 working days after the Activation process.
- Your UCare Membership Number is a unique number assigned to your UCare Membership and it must be stated during your membership Activation. Your UCare Membership Number can be found on the front of your UCare Membership Card.
- It is important to keep the Membership Card and it MUST be presented to UCare Service Centre for the purpose of making any warranty claims.
- UCare is valid ONLY in relation to the Product for which your Membership has been registered. It is the Product that is warranted rather than the owner (hereinafter referred as “Member”).
- UCare Membership cannot be transferred to any other product once activated. However, the UCare Membership is transferable to a new owner of the Product and will cover transferees or second-hand buyers within the terms and conditions stated here, and the member must notify UCare Service Centre immediately upon the transfer.
- UCare is available for non-Malaysians working or studying in Malaysia. However, all claims can only be made at UCare Service Centre or UCare Collection Centre in Malaysia.
- UCare is non-renewable and is only valid during the Coverage Period on the second year from the date of purchase of the Product.
- This UCare shall be rendered null and void if:
- UCare Membership is NOT successfully activated.
- the Product is damaged as a result of connection to irregular voltage sources.
- the Product is installed, maintained, operated or use other than in accordance with the instructions
- provided by the manufacturer in relation to the Product.
- the Product is altered, modified, serviced and repaired by any party other than UCare Service Centre, except by the original manufacturer during the first year from date of purchase of the Product.
- the Product or component serial numbers have been obliterated, altered, obscured or tempered with.
- the Product is not purchased from authorised sales channels in Malaysia.
- member cannot present the UCare Membership Card, sales receipt and purchase invoice when requested.
- warranty period has expired.
F) Limit of Liability
- UCare's sole obligation under this warranty shall be, at its option, to repair or replace the product or any components free of charge, in the event of any failure or defect covered by the extended warranty arising during the Coverage Period and falls within the Scope of Coverage.
- Upon approval of warranty claim by the insurer company, ZipOne Sdn. Bhd. shall undertake to repair or replace the Breakdown item similar to the original purchase item. However, if the similar item is not available or discontinued in the market, it shall be replaced with an item of equivalent specification or in value not exceeding the market price.
- All warranty claims on repair and/or replacement of part(s), component(s) or product, including labour charges, or in total for all warranty claims in the aggregate should not exceed and is limited up to the Purchase Price of the Product.
- If any cost of repair or aggregate of repairs is likely to exceed the prevailing retail price of the Product, then a replacement item of the same product or a product of like functionality will be offered in settlement and Coverage under that UCare will prematurely terminate on the date that the product was replaced.
- ZipOne Sdn. Bhd.'s liability shall be limited to the amount paid for the price of each single item and/or shall not exceed the total Purchase Price of the insured Product.
- If not covered or exceeded the value of the insured Product, the costs of repair or replacement will be borne
- If a warranty claim made is false or fraudulent or intentionally exaggerated or if any false declarations or statements be made in support thereof no claim shall be recoverable hereunder.
- ZipOne Sdn. Bhd. reserves the absolute right to determine whether the Breakdown is within or beyond economic repair. Any decision made by ZipOne Sdn. Bhd. is final and the Member shall have no further rights to contest the decision or make any claims against ZipOne Sdn. Bhd.
- This warranty shall be rendered null and void if:
- the Product is damaged due to any accidents, transportation, fall, weather, extreme temperatures, shock, improper use, mishandling or negligence after the purchase of the Product;
- the Product is damaged as a result of natural disaster or acts of God, e.g. fire, flood, lightning.
- ZipOne Sdn. Bhd. or its UCare Service Centre will not be liable for:
- any loss, claim, death or injury to persons or damage to property for incidental, consequently, indirect, special or punitive damages of any nature, including, without limitation, lost business profits howsoever arising out of this Agreement of the Member's possession indemnity shall survive the termination of this Agreement, or
- any damage, malfunction, corruption or loss of any hardware, software or data; or for any delay in servicing for the duration that UCare Service Centre has possession of the Product.
- Furthermore, the Member also agrees to indemnify and to indemnify ZipOne Sdn. Bhd. or its UCare Service Centre against any action that results in such damage, malfunction, corruption, loss or delay.
G) Warranty Claims for Service, Repair or Replacement
- UCare Service Centre, its Authorised Service Centre and Authorised Dealers reserve the right to request proof of purchase (e.g. a paid and dated invoice from your Authorised Dealer) showing model and serial number before accepting liability for any warranty claim.
- All products and components replaced under UCare shall become ZipOne’s Sdn. Bhd.’s property.
- The member is responsible to back up all programs and data contained in the Product before allowing or sending it to UCare Service Centre for service, repair, replacement, etc.
- The Product is handed over to UCare Service Centre at the Member's own risk.
- Subject to the terms and condition stated in this booklet, no Excess is required when making the warranty claims.
- UCare Membership will be void and invalid if members attempt to repair or replace any parts of the Product.
- ZipOne Sdn. Bhd. does not provide cash settlement.
- All warranty claims must be supported with the relevant documentations that are:
- UCare Membership Card with the Membership Number registered for the Product
- Photocopy of Member's Identity Card (IC) or Passport
- Completed Claim Form
- Proof of Purchase or Invoice of the Product
- The costs of dismantling of the Product will be borne by ZipOne Sdn. Bhd. in the event of a valid and approved warranty claim. However, if upon dismantling it should be found that the damage is not within the coverage scope of UCare, then the cost of dismantling must be paid by the Member upon collecting the Product.
H) Exclusions
- UCare does not cover:
- Product purchased for commercial usage (except for office computers which are used for home and light office use).
- Product where the serial number has been obliterated, altered, obscured or tempered with.
- any problem, defect or damage that are NOT covered by manufacturer’s warranty.
- any defects which are subject to a manufacturer’s recall or which are covered under a manufacturer’s program of reimbursement.
- normal routine maintenance, cleaning, lubrication, adjustments or alignment.
- parts requiring replacement due to normal wear and tear, corrosion, rust or stain that are not integral or necessary to the functioning of the Product or routine service, or if the wear and tear on the part has exceeded the field tolerances allowed by the Manufacturer.
- any component or accessory upgraded or added-on during or after the purchase.
- expendable parts of the Product or to the parts of the Product that are exposed to wear and tear in the normal course of product usage. Examples include but not limited, such as batteries, product casing/housing, carry case, external cables, external keyboards, external mouse, external speakers, external microphone, power adaptor and projector lamp.
- appearance or structural items, such as housing, case or frame, decorative parts or parts designated to be replaced periodically during the life of the Product, add-on items, accessories or attachments, external wiring and cabling, battery chargers, racks, bins, knobs, handles, antennas, remote control
- reception and/or transmission problems resulting from external causes, modem or data transfer devices
- any software preloaded on or otherwise sold with the Product.
- LCD panels physically damaged due to external pressure, accidental drops, spills and extreme temperature, and such damages are noticeably viewable. Examples include but are not limited, such as scratches, imprint/water marks, cracks and dents.
- any accessory or equipment such as software, peripherals and/or add-on options incorporated in a product not essential to the basic function of the product. Examples include but arenot limited to consumables such as DVD discs, CD discs, tapes, diskettes or softwareand add-on options.
- any damage to or loss of any programs or data.
- recovery of corrupted hard disk drive.
- any problem, defect or damage to the part(s) and/or component(s) that is(are) caused by or arising from:
- unauthorized repair personnel. Unauthorized repair or replacement of the Product shall result in the cancellation of this plan,
- unauthorized modifications or failure to follow the manufacturer’s installation, operation or maintenance instructions,
- third party use or any other party other than the member him/herself,
- the use of third party optional products or consumables in conjunction with the product,
- usage of unauthorized or poor quality CD ROMs,
- computer virus or realignment to products,
- directly and/or indirectly from software installation and removal,
- using unauthorized or poor quality floppy disks,
- accidents, negligence, carelessness or intentional acts, or
- fire, theft, burglary, accident, neglect, misuse, abuse, or Acts of God including but not limited to earthquake, storm or tempest (wind), sand, water, flood, rising water, lightning, malicious damage, aircraft, vehicle impact, corrosion, battery leakage, power outages or surges, inadequate or improper voltage, or current, animal or insect infestation.
- Any failure, malfunction, defect, inoperability, breakdown, disruption or stoppage of the product or any product functions or the function of any related components caused by, arising from or related to directly or indirectly any design, planning or engineering compatibility, omission or deficiency with the incidents of the year 2000.
I) Others
- ZipOne Sdn. Bhd. reserves the right to reject any application if applicant supplies misleading, incomplete information or makes any misrepresentation.
- If any of the term(s) under the UCareis held by any competent authority to be invalid, such term(s) shall be severed whilst all remaining terms shall remain valid.
- ZipOne Sdn. Bhd. reserves the final decision in the event of a dispute.
- ZipOne Sdn. Bhd. reserves the right to change the terms and conditions without prior notice.
